By accessing or purchasing from noctistint.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site or place orders.

2. Use of the Site

You may use the Site for personal, non-commercial purposes. You may not use the Site for any unlawful purpose, to violate any laws in your jurisdiction (including but not limited to copyright laws), or to transmit any malicious or unsolicited content.

3. Products and Pricing

We make every effort to display the colors, descriptions, and pricing of our products accurately. However, we cannot guarantee that your monitor's display of any color will be accurate. All prices are listed in US Dollars and are subject to change without notice. We reserve the right to modify or discontinue any product at any time.

4. Order Acceptance

Your order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including but not limited to product unavailability, errors in product or pricing information, or suspected fraud. If we cancel an order after payment, we will issue a full refund.

5. Color and Appearance Disclaimer

Window tint films vary in appearance based on lighting conditions, viewing angle, the underlying glass, vehicle paint color, and your monitor calibration. Product photos are representative but cannot perfectly predict how a film will look on your specific vehicle. By placing an order, you acknowledge this variability and agree that color or appearance differences are not grounds for return after installation.

6. Installation

Window tint installation requires skill and proper preparation. You assume full responsibility for the installation of any film purchased from Noctis Tint, whether self-installed or installed by a third party. We are not liable for installation errors, glass damage, or any consequential damages arising from improper installation.

7. Compliance with Local Laws

Window tint laws vary by state, province, and country. Some films we sell may not be legal for use on certain windows in your jurisdiction. You are solely responsible for verifying that any film you purchase complies with local laws before installation. Noctis Tint is not liable for fines, citations, or vehicle inspection failures resulting from non-compliant installations.

8. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, product descriptions, and blog posts, is the property of Noctis Tint or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. User Content

If you submit reviews, comments, photos, or other content to the Site, you grant Noctis Tint a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display such content in connection with our business. You represent and warrant that you own or have the necessary rights to all content you submit.

10. Limitation of Liability

To the maximum extent permitted by law, Noctis Tint shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or any product purchased through it. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Noctis Tint, its officers, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of another party.

12. Modification of Terms

13. Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Denver County, Colorado.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
